Judge tosses out Cowlitz Tribe record of decision in surprising move

The ruling to terminate the 2010 decision stems from an acknowledgement by the Bureau of Indian Affairs that key documents submitted by the plaintiffs were missing and not considered when the record of decision was made. Those documents, said Bockmier, challenge the tribe’s claim that it had ties to the north Clark County land.

Those involved with the case aren’t entirely sure what will happen next. Bockmier noted that the plaintiffs are seeking further clarification from Judge Rothstein about Wednesday’s ruling. Meantime, he said, the idea that the BIA could issue a new record of decision in 60 days seems unlikely, given that it took three years to issue the 2010 decision.
